Land Division

A Land Division Survey is performed when a property owner wishes to split a parcel into two or more smaller, legally recognized lots. This process must comply with the Michigan Land Division Act (Public Act 288 of 1967, as amended) and requires approval from the local governing body. Land divisions are common for property sales, estate planning, development, or to adjust ownership boundaries for family or business purposes.

What’s Included in a Land Division Survey?

  • Boundary Survey of Parent Parcel: A complete survey of the original parcel (parent parcel) is conducted to confirm existing boundaries and locate any existing monuments or improvements.

  • Proposed Split Configuration: Preparation of a detailed plan showing the proposed new parcels, including lot dimensions, area calculations, access points, and conformance with zoning regulations such as minimum lot size and road frontage requirements.

  • Updated Legal Descriptions: New legal descriptions are prepared for each proposed parcel, ready for use in deeds and for recording with the county Register of Deeds.

  • Land Division Drawing: A formal survey drawing is prepared in accordance with Public Act 132 of 1970 and is recorded at the Register of Deeds, providing a legal and permanent public record of the division.

  • Coordination with Local Approval Process: NJR Land Surveying, LLC will assist in submitting the required documents to the local township or city for review and approval of the land division, ensuring compliance with local ordinances and the Land Division Act.
